Executors and estate partitioners

We offer our services as executors and estate partitioners. These are auxiliary probate roles that are especially useful when the testator needs someone they can trust, after their death, to carry out the distribution of the estate and help avoid disputes and litigation among the heirs

This allows the testator to ensure that their wishes will be respected and that disputes among heirs are prevented.

1. Executor: The guardian of the testator’s wishes

The executor is the trusted person appointed to carry out the provisions of the will. Their main duties include:

  • Safeguarding assets: ensuring the security of the estate
  • Executing the will: ensuring that each legacy is delivered as intended
  • Funeral arrangements: organizing the arrangements set out by the testator

2. Estate Partitioner: Precision and fairness

Unlike the executor, the estate partitioner performs a strictly technical and decisive role:

  • Inventory and valuation: objectively determining the value of the assets
  • Dissolution of he marital property regime: separation of the estate from the surviving spouse’s assets where necessary
  • Distribution: dividing the assets among the heirs, avoiding the need for unanimous agreement (which is often the source of disputes)
